(1) The goods delivered shall be checked by ourselves within a reasonable period as to faults relating to quantity.Recognisable faults may be notified up untill the expiration of 14 working days following their discovery.
(2) We shall be entitled to exercise without restriction our respective statutory wattanty claims as they apply for the time being.
(3) Should faults be discovered by us in relation to a product,to remedy which,in all probability,will involve costs of not more than EUR300 we may,in order to ensure the avaliability of the goods and to prevent losses in sales,ourselves arrange for the remedial action to be taken but at the cost of the Supplier.The Supplier may demand production of the notice of damage from our incoming goods check and the production of the invoice concerning the remedial action.
(4) In the case of legitimate complaints in relation to the goods,and in relation to any infringements of the delivery provisions,a contractual penalty of EUR300 shall be payable for the additional time and the expenditure thereby incurred.Should damages be claimed by us on account of the same facts within the framework of the statutory warranty provisions,the contractual penalty paid shall be deducted from the amount of damage thereby actually ascertained.
(5) The warranty period shall amount to 24 months following delivery of the goods to one of our stores.
(6) In the event of delays in payment for which we are responsible,we shall pay default interest following agreement with the Supplier,subject to a maximum of amount specified by statute.
(7) The Suppler shall not be entitled without our consent to assign claims it has against us to third parties.
(8) We requie the Supplier to contribute to the costs of the environmental recycling measures consequent upon the deliveries in the amount of 1% of the net sales of the products purchased from it.The costs in this respect are,inter alia,divided into disposal costs for transport and sales packaging and environmental protection measures related to the product.The payment by the Supplier shall,subject to any payments on account,be made annually by 15th February of the following year without specific demand being made.
