内容摘要：离婚损害赔偿制度是规定配偶一方因其过错行为,不法侵害配偶他方基于配偶身份所享有的合法权益,导致婚姻关系破裂,配偶他方得请求赔偿其财产上的损失和非财产上的损失的民事法律制度.我国2001年修改的《婚姻法》,首次在婚姻家庭法中确立了离婚损害赔偿制度,但该制度自身存在很多不完善.在实际生活中当事人因家庭暴力、重婚、同居、虐待、遗弃而导致的离婚行为而遭受的身心痛苦远远超过了可以计算的财物损失.本文主要通过“包二奶”及重婚现象和导致离婚的四种法定情形着重介绍关于离婚损害赔偿中的精神损害赔偿行为,以及相应的法律救济,从而捍卫无过错方的合法权益.
